Legislation
The regulatory framework that underpins the registration and monitoring of providers offering courses to student visa students in Western Australia is the State Education Service Providers (Full Fee Overseas Students) Registration Act 1991 a nd associated Regulations (ESPRA).
There is a nexus between the ESPRA and the Commonwealth Education Services for Overseas Students 2000 (ESOS) and associated National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2007 (The National Code).
In order to be placed on the Commonwealth Register of Institutions and Courses for Overseas Students providers must comply with both the State and COmmonwealth requirements. The Department administers the ESPRA and in conjunction with the Commonwealth Department of Education, Employment and Workplace Relations, ensures that providers meet the requirements of the ESOS and The National Code.
