Operation of an Interstate University through an Agent

Under the Higher Education Act 2004, an interstate university must not operate under an agency arrangement in Western Australia without the Minister’s approval.

Protocol 4 of the National Protocols for Higher Education Approval Processes relates to universities operating at a distant location in their own name or universities operating through another organisation.  In the latter arrangement, if the university is the owner of the course and grants the academic award, the relationship will be considered as one of ‘principal and agent’ where the principal must carry full responsibility for all aspects of delivery.  Quality assurance measures undertaken by the university will be reviewed by AUQA as part of the institution’s audit process.
